Client Terms & Conditions

Usage, Copyright, Privacy, Model Release & Session Policy

By executing this agreement, the Client enters into a bespoke service relationship with At Ease Photography, LLC, operated by Jamie Dale-Justice (“Photographer”), and agrees to the following terms:

Artistic Use & Copyright

The Client grants the Photographer the irrevocable and unrestricted right to photograph, record, edit, reproduce, publish, display, and otherwise use images created during the session for refined business purposes. Such use may include portfolio curation, website presentation, social media, editorial features, print publications, studio samples, competitions, and select marketing placements, without further notice, approval, or additional compensation. This authorization extends across all media formats, platforms, and technologies, whether now known or hereafter developed, and may be exercised worldwide, in perpetuity. All images remain the sole and exclusive intellectual property of At Ease Photography, LLC and are protected under applicable copyright laws.

Model Release & Personal Likeness

For valuable consideration received, the Client grants the Photographer full permission to use the likeness, image, voice, and appearance of all individuals participating in the session (“Subjects”).

The Photographer retains full creative discretion in the editing, retouching, and artistic presentation of all imagery. The Client waives any right to inspect or approve the final images or their use.

The Client further releases and discharges the Photographer from any claims arising from the use of such imagery, including but not limited to claims for libel, invasion of privacy, or infringement of publicity rights.

Minor Consent

The Client affirms that they are the parent or legal guardian of any minor participating in the session, or have obtained proper legal consent from the minor’s parent or guardian.

By signing, the Client grants all rights outlined in this agreement on behalf of the minor(s) and accepts full responsibility for their supervision, safety, and participation.

The Client agrees to indemnify and hold harmless At Ease Photography, LLC from any claims arising in connection with the participation or representation of said minor(s).

Optional Privacy Election

At Ease Photography, LLC respects the discretion and privacy of its clientele. Clients who prefer their images remain unpublished may request a written limitation of use prior to the session.

Such requests are considered with care and may be accommodated at the Photographer’s discretion, and may involve an additional creative or licensing fee.

Clients are warmly invited to share their images. When doing so, thoughtful credit is appreciated:

Image Quality & Print Assurance

At Ease Photography, LLC ensures exceptional color accuracy and archival quality exclusively through its professional print lab, accessible via the Client’s private gallery. The Photographer cannot guarantee the quality, color rendering, or longevity of prints produced through third-party vendors.

Session Reservations, Rescheduling & Cancellations

Each session is reserved with intention and dedicated exclusively to the Client upon receipt of a signed agreement and any required retainer.

Retainer & Reservation

The retainer secures the Client’s date and ensures the Photographer’s availability. As a reflection of this commitment, retainers are non-refundable.

Rescheduling

Should a change become necessary, the Photographer is pleased to accommodate one rescheduling request with a minimum of twenty four (24) hours’ notice. Rescheduled sessions are typically arranged within sixty (60) days of the original date and are subject to availability. Additional adjustments may be accommodated where possible and may include a rescheduling consideration.

In circumstances such as inclement weather, illness, or conditions that may compromise the integrity of the session, the Photographer may recommend rescheduling in order to preserve the highest standard of imagery.

Cancellations

In the event a session is cancelled in less than twenty four (24) hours of the scheduled session, the retainer may be retained, as the reserved time is unlikely to be reassigned.

Timing Considerations

To ensure a seamless experience, Clients are encouraged to arrive promptly. Adjustments to session length may be necessary in the event of a delayed arrival. Significant delays may be treated as a cancellation at the Photographer’s discretion.

Non-Attendance

A session that is missed without prior notice will be considered a cancellation, and payments made will be retained. If At Ease Photography misses a scheduled appointment due to unforeseen circumstances, client will be credited retainer, and rescheduled session will be complimentary.

Liability & Property Considerations

Sessions may take place on private At Ease Estate grounds spanning approximately 13 acres, inclusive of natural landscapes, varied terrain, and water features. By attending, the Client accepts responsibility for themselves and their guests while on the property. To the fullest extent permitted by law, At Ease Photography, LLC shall not be held liable for any injury, loss, or damage arising from participation in the session or presence on the premises. All minor children must remain within immediate reach of a parent or legal guardian at all times.

Indemnification

The Client agrees to indemnify, defend, and hold harmless At Ease Photography, LLC from and against any claims, liabilities, damages, or expenses arising from participation in the session or breach of this agreement.

Legal Capacity & Governing Law

The Client affirms they are at least eighteen (18) years of age and legally competent to enter into this agreement. This agreement shall be governed by and interpreted in accordance with the laws of the State of Ohio and shall be binding upon the Client and their heirs, representatives, executors, successors, and assigns.
